These Terms and Conditions apply to training and eLearning services provided by The Phlebotomy Centre Ltd (“The Phlebotomy Centre”, “we”, “us” or “our”).

Please read these Terms and Conditions carefully before booking or purchasing any training through our website. By making a booking or purchase, you agree to these Terms and Conditions.

1. About us

The Phlebotomy Centre Ltd provides specialist phlebotomy education and training, including practical phlebotomy training, corporate training and eLearning.

2. Our training

Information about individual courses, including course content, location, delivery format, dates and prices, is provided on the relevant course page or quotation.

We take reasonable care to ensure that course information is accurate. We may make reasonable changes to course content, materials, trainers, venues or delivery arrangements where necessary, provided these do not materially reduce the overall nature of the training purchased.

Training and competency

Completion of a training course does not, by itself, guarantee that a learner is competent to practise phlebotomy independently.

Our training is designed to provide relevant knowledge and/or practical skills development. Learners may require further supervised practice, workplace assessment or competency sign-off depending on their intended role, employer, professional responsibilities or clinical environment.

It is the learner's and, where applicable, employer's responsibility to ensure that appropriate competency requirements are met before undertaking phlebotomy independently.

Employment

Completion of training with The Phlebotomy Centre does not guarantee employment or eligibility for any particular role.

Employers determine their own recruitment, qualification, competency and experience requirements.

3. Booking practical training

A booking is not confirmed until the required booking process has been completed and any payment due at the time of booking has been successfully received.

Following booking, you will receive confirmation using the contact details supplied to us.

You are responsible for ensuring that the information provided when booking is complete and accurate.

Places on scheduled courses are subject to availability.

4. Course fees and payment

The price payable for scheduled training will be displayed during the booking process.

Payment must be made using one of the payment methods available through our website unless alternative arrangements have been agreed by us in writing.

For corporate training, prices will normally be provided by quotation and payment arrangements will be stated on the quotation or invoice.

We reserve the right to correct genuine pricing errors. If an error affects a booking you have already made, we will contact you before providing the service and give you the opportunity to proceed at the correct price or receive a refund.

5. Corporate training

Corporate training is quoted according to the organisation's requirements and may take into account factors including learner numbers, location, travel, venue requirements, course content and delivery arrangements.

A corporate booking will only be confirmed once we have accepted the booking and any requirements stated within the quotation have been satisfied.

Where invoicing has been agreed, payment must be made within the payment terms stated on the invoice.

The organisation is responsible for providing accurate information about its training requirements and, where training is delivered at its premises, ensuring that an appropriate and safe training environment is available.

Any organisation-specific cancellation or rescheduling terms included within an accepted quotation will form part of the agreement between the organisation and The Phlebotomy Centre.

6. Cancelling or changing practical training

If you are unable to attend your booked course, please contact us as soon as possible.

Requests to transfer to another course date are subject to availability and our applicable cancellation or transfer policy.

Where a booking is cancelled, any entitlement to a refund will depend on the circumstances, the notice provided and your applicable statutory rights.

Where you are booking as a consumer, nothing in these Terms and Conditions affects any cancellation or other rights you may have under applicable consumer law.

If you request that a service begins during any applicable statutory cancellation period, your cancellation rights may be affected once the service has begun or been fully performed, as permitted by law.

7. Cancellation or changes by The Phlebotomy Centre

Occasionally, circumstances outside our reasonable control may require us to change a course date, venue, trainer or other delivery arrangements.

Where possible, we will provide reasonable notice of any significant change.

If we have to cancel a scheduled course, we will normally offer you:

  • a transfer to an alternative available date; or

  • a refund of the course fee you have paid.

We are not responsible for additional costs you choose to incur in connection with attending training, such as travel or accommodation, except where liability cannot legally be excluded.

We therefore recommend avoiding non-refundable travel or accommodation arrangements where possible.

8. Learner conduct and safety

Learners are expected to behave professionally and respectfully towards trainers, other learners and any individuals involved in practical training.

You must follow reasonable instructions provided by the trainer, particularly those relating to health, safety, infection prevention and practical procedures.

We reserve the right to prevent a learner from participating in practical activities, or to ask a learner to leave training, where we reasonably believe that their behaviour:

  • presents a risk to themselves or another person;

  • compromises patient or learner safety;

  • is abusive, threatening or significantly disruptive;

  • involves deliberate failure to follow safety instructions; or

  • otherwise makes continued participation inappropriate.

Our trainers may also decide that a learner requires further training or supervised practice before progressing with particular practical activities.

A certificate of attendance or completion must not be interpreted as confirmation of independent clinical competency unless this is expressly stated as part of a specific competency assessment.

9. eLearning

eLearning courses provide online educational content and do not, by themselves, demonstrate practical competency in venepuncture.

Where practical competency is required, learners should undertake appropriate practical training, supervised practice and any competency assessment required by their employer or clinical environment.

Access arrangements, course content and any applicable completion period will be described on the relevant eLearning course page or within joining information.

Login details are provided for the individual learner and must not be shared with another person unless we have expressly authorised this.

We may suspend access where we reasonably believe an account is being misused or course materials are being shared without permission.

10. eLearning cancellation rights

Your statutory cancellation rights may differ for digital content.

Where you purchase digital content and request or agree to immediate access during a statutory cancellation period, you may be asked to expressly consent to immediate supply and acknowledge that this may affect or result in the loss of your right to cancel once supply of the digital content begins, where permitted by law.

Nothing in these Terms and Conditions limits your statutory rights.

11. Certificates

Certificates are issued where the applicable course requirements have been successfully completed.

Certificates relate only to the training or learning completed and should not be altered or used in a misleading way.

Where a course is CPD accredited, this will be stated on the relevant course information. We do not represent that every course is accredited unless expressly stated.

12. Course materials and intellectual property

Course materials, presentations, eLearning content, videos, documents, graphics and other educational resources provided by The Phlebotomy Centre are protected by intellectual property rights.

Unless we give written permission, course materials are provided for your personal learning only and must not be:

  • copied or reproduced for commercial purposes;

  • distributed to other people;

  • uploaded or published online;

  • used to deliver training to others;

  • resold; or

  • substantially reproduced in another course or training programme.

13. Technology and eLearning availability

We take reasonable steps to maintain access to our online learning services but cannot guarantee that digital services will be uninterrupted or error-free at all times.

Access may occasionally be temporarily unavailable due to maintenance, technical issues or circumstances outside our reasonable control.

If a significant technical problem prevents you from accessing purchased learning, please contact us so that we can investigate and provide an appropriate solution.

14. Your personal information

We process personal information in accordance with our Privacy Policy.

Information may be collected where necessary to administer bookings, deliver training, provide eLearning access, issue certificates, respond to enquiries and meet our legal or regulatory obligations.

15. Our responsibility to you

We will provide our services with reasonable care and skill.

We are responsible for foreseeable loss or damage caused by our failure to comply with these Terms and Conditions or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

16. Business customers

Where training is purchased wholly or mainly for business purposes, we will not be liable for indirect or consequential business losses, loss of profit, loss of revenue, loss of business opportunity or business interruption except where liability cannot legally be excluded.

Any specific terms agreed within a corporate quotation or written agreement will apply alongside these Terms and Conditions. Where there is a direct conflict, the specifically agreed written terms will take precedence for that booking.

17. Complaints

If you are dissatisfied with any aspect of our service, please contact us as soon as possible so that we have an opportunity to investigate and respond.

18. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time to reflect changes to our services, business practices or legal requirements.

The Terms and Conditions applying to your purchase will normally be those in effect when your contract with us was formed, unless a change is required by law.

19. Governing law

These Terms and Conditions are governed by English law.

If you are a consumer, you may bring legal proceedings in the courts applicable to your part of the United Kingdom.

If you are acting in the course of business, the courts of England and Wales will have jurisdiction unless otherwise agreed in writing.

20. General

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

A delay by us in enforcing any provision does not mean that we have waived our right to enforce it later.

No person other than you and The Phlebotomy Centre Ltd has any right to enforce these Terms and Conditions unless expressly stated otherwise.
